Newegg is liable for selling possibly faulty parts without putting them through stringent fault tests prior to reselling the item.

Newegg can try and use legal bull**** all they want but the people in the know can and will force newegg to replace any part which is faulty.

Cost vs benefits, you're not going to start a case against a huge company over a $80,- videocard.

Funny you should mention that because they sent a buyer of a new GTX295 an open box item.....even though he paid $500.

Ill check the card over thoroughly when I get it.
