PS3 hack lawsuit: Sony settles

Sony Computer Entertainment America (“SCEA”) and George Hotz (“Hotz”) today announced the settlement of the lawsuit filed by SCEA against Hotz in federal court in San Francisco, California. The parties reached an agreement in principle on March 31, 2011. As part of the settlement, Hotz consented to a permanent injunction.

Both parties expressed satisfaction that litigation had been quickly resolved. “Sony is glad to put this litigation behind us,” said Riley Russell, General Counsel for SCEA. “Our motivation for bringing this litigation was to protect our intellectual property and our consumers. We believe this settlement and the permanent injunction achieve this goal.”

“It was never my intention to cause any users trouble or to make piracy easier,” said Hotz, “I’m happy to have the litigation behind me.” Hotz was not involved in the recent attacks on Sony’s internet services and websites.

In the action, SCEA accused Hotz of violating federal law by posting online information about the security system in the PlayStation 3 videogame console and software that SCEA claimed could be used to circumvent the security system in the console and allow the playing of pirated videogames. Hotz denies any wrongdoing on his part. Hotz’s motion to dismiss for lack of personal jurisdiction was still pending before the federal court in San Francisco but a preliminary injunction was issued requiring Hotz to take down the postings challenged by SCEA.

“We want our consumers to be able to enjoy our devices and products in a safe and fun environment and we want to protect the hard work of the talented engineers, artists, musicians and game designers who make PlayStation games and support the PlayStation Network,” added Russell. “We appreciate Mr. Hotz’s willingness to address the legal issues involved in this case and work with us to quickly bring this matter to an early resolution.”

    so what are the terms of the settlement?

    is geohot banned from hacking his ps3 any further?
    did one of the parties have to pay any money to the other party?

    without knowing the agreement they settled on, we don't know who 'won' or not.

    Apparently sony obtained that geohot no longer hacks sony devices.
    From his end, he apparently will be boycotting sony devices from now on.

    With the xperia play just out and the NGP coming, its no wonder they dont really want to aggravate the masses further.
    The Anonymous assaults on sony's web and PSN infrastructure couldve possibly been a situation sony was unwilling to let drag on.

    There doesnt seem to be mention of monetary payments.

    if that's the case then geohot effectively lost.
    although if i was in his shoes i would've settled for that deal as well.

    Who knows if he'll actually stop hacking.. Maybe he'll become Geohat and use super-secure VPNs?

    Actually I dont think so.
    If sony felt it couldve won, it wouldve pressed on netherless.

    That they chose to give up tells another story. Perhaps they didnt wish to risk console jailbreaking to be declared legal.

    thats a possible reason.
    but it could also be because this was their ultimate goal in the first place.
    what did they want to get out of suing geohot?
    what they wanted was for him to quit hacking their consoles, and to halt the progress of other hackers by scaring them with lawsuits.
    they ended up getting what they wanted now that geohot can't hack their consoles anymore; they got what they wanted so no reason to continue.

    its not like geohot has massive amounts of money that sony could've gained by winning their case. there's nothing sony could've gained by pursuing this case further aside from bad publicity and being the target of anonymous.

    Scaring people into stopping touching the console. They sued graf for a million dollar (which they couldve bumped up to 10 billions, for all you know).
    Didnt exactly deter him from making ps3 modding an obsession rather than just an occasional passion. The result of his private research is now in the wild, cat's not going back into the bag.

    Sure, that intimidation "worked" somewhat till 'anonymouses' suddenly started popping out from the woodwork instead. What remained in the beginning literally a barely known hack was made by Sony and then manstream media into common knowledge for the world now: the ps3 is hacked, free games woohoo, come and get some!

    I am a little disappointed in Geohot.... He and i Come from a country that supposedly values freedom... Who the hell is Sony to say HOW we use our devices that we purchase from them?
    So am i to take from this that any company has the right to tell their customers how we use their devices and machinery? Is my car going to suddenly dont the voice of kit and say mean things to me if i put the wrong kind of fuel in it. What if i decide to install solar panels on my house, is the local power company going to come to my house and make me purchase energy from them?!

    i was extremely peeved with how Sony removed the other os option... it seems somehow with the playstation 3, sony has gained control of the American populace. you know if i had half the talent Geohot has and knew the things he did about the playstation's security system id circumvent it the best way i know how, as an added bonus id present a custom firmware that allowed users to use a open networking system in lieu of PSN.

    whatever Sony, im going to paint my ps3 so it reads FascistStation 3
